TERMS AND CONDITIONS OF steki.pl ONLINE SHOP
§ 1
[General Provisions and Definitions]

These Terms and Conditions define the terms and conditions of using the Shop available at the web address www.steki.pl, including the rights and obligations of Buyers as well as the rights and obligations of the Seller, who manages and operates the Shop.

Whenever the following terms are used in these Terms and Conditions, they shall have the following meanings:

Registration form – A form available in the Shop that allows the creation of an Account.

Order form – A form available in the Shop that enables placing Orders, including adding Products to the Cart and determining the terms of the Sales Contract, such as delivery and payment methods.

Account – An individual Buyer’s account containing data on transactions conducted and a tool for managing Orders placed by the Buyer.

Cart – A feature of the Shop’s platform where the selected Products for purchase are displayed, allowing modifications to Order details, including the quantity of Products.

Buyer – Either a Consumer (an adult natural person with full legal capacity under civil law, entering into a contract unrelated to their business or professional activity with the Seller) or a Business Entity (a natural person, legal entity, or organisational unit with legal capacity under separate legislation, conducting business activities in their name, entering into a contract with the Seller through the Shop).

Shop – The online store operated by the Seller at www.steki.pl, selling Products remotely.

Seller, Shop Owner, Data Administrator – A natural person conducting business under the name "Produkcja Handel Doradztwo Mateusz Ludwiniak," registered in the Central Register and Information on Economic Activity (CEIDG) maintained by the Minister responsible for the economy, NIP /Tax Identification Number/ 8222213344, REGON /National Business Registry Number/ 141829976.

Privacy Policy – An integral part of these Terms and Conditions, defining the principles of processing Buyers’ personal data by the Seller.

Product – Goods available in the Shop, presented as the minimum and indivisible quantity of items that can be ordered.

AgreementA sales contract under the Civil Code between the Business Entity and the Seller via the Shop, specifying the Product, its main characteristics, quantity, price, delivery costs, and other significant terms.

Order – The Buyer’s declaration of intent to enter into a sales contract, submitted via the Order Form, specifying the type and quantity of Products, delivery method, payment method, and delivery location.

Price – The amount the Buyer is obliged to pay for the purchased Products under the Agreement. Prices are expressed in Polish zloty (PLN) and include VAT. Product prices do not include delivery costs.

Placing an Order in the Shop requires reading these Terms and Conditions, available on the website, and accepting their provisions.

§ 3
[Technical Requirements for Using the Shop]

To use the Shop, which includes browsing the Shop’s assortment and placing Orders for Products, the following are required:

A device with Internet access.

An operating system: Windows, Linux (with a graphical console), Mac OS, or Android.

An up-to-date web browser supporting JavaScript: the latest versions of Internet Explorer, Google Chrome, Mozilla Firefox, Safari, Opera, or their mobile equivalents.

Enabled cookies.
-
Installed FlashPlayer software.
-
An active email account.
-
A mobile phone number.
-
Buyers may consent to enabling cookies. Detailed information on the purpose of storing and accessing information using cookies, as well as how Users can define storage conditions or access information in cookies via their device settings, is available in the Privacy Policy.
§ 4
[Terms of Use of the Shop]

Using the Shop is possible provided the Buyer’s IT system meets the technical requirements specified in §3 above.

Browsing the Shop's assortment does not require creating an Account.
-
Purchases in the Shop are made by placing an Order.
-
Buyers may place Orders for Products listed in the Shop’s assortment either by creating an Account or without creating an Account, by providing the necessary personal and address details in the Order Form to enable Order fulfilment, in accordance with these Terms and Conditions.

The Seller stipulates that Buyers who are Consumers must have full legal capacity to make purchases in the Shop.
§ 5
[Account: Registration and Login]

The following free services are provided electronically by the Seller in the Online Shop:

Buyer Account service;
-
Order Form service;
-
Newsletter service.
-

During registration, the Buyer must tick: „I have read and accept the Terms and Conditions of the Online Shop”.
-
The login password is individual to each Buyer and must contain at least 6 characters. Password changes can be made via the Shop’s functionality by providing an email address and a new password. The Buyer must not share the Shop Account password with third parties.

After registration, the Buyer will receive a confirmation email with a link.
-
Clicking the link activates the Account.
-
Account activation allows Buyers to:
-
Access the status and history of their Orders;
-
Place Orders via the Order Form;
-
Update personal details;
-
Change their password;
-
Review their Orders;
-
Delete their Account, along with the data stored within it.
-
Buyers may deactivate their Account at any time by sending a resignation statement to sklep@steki.pl or in writing to the Seller’s address without incurring additional costs or providing reasons. The Account will be deactivated within 7 business days of receiving the statement.

The Seller reserves the right to deactivate an Account, notifying the Buyer via email, if the Buyer provides unlawful content or engages in unauthorised interference with the server.

Registering an Account is not a prerequisite for placing an Order in the Shop.

The rules for providing electronic services via the Order Form are specified in these Terms and Conditions.

The rules for electronic services relating to free Newsletter messages are detailed in a separate Newsletter Terms and Conditions document.
§ 6
[Orders: Placing Orders]
-
The Shop is open 24/7 throughout the year, allowing Buyers to place Orders at any time, excluding maintenance breaks.

To place an Order:
-
Select a product and its weight variant, then click "Add to Cart."
-
After adding all products in the cart, click "Order Now."
-
The estimated delivery date will appear on the screen if payment is made immediately after placing the Order.
-
To continue with the Order, log in via Facebook or Google accounts.
-
Orders can be made following one of the three options described below.
-
Next, click "Summary."
-
After verifying the products and cart value, click "Confirm Purchase."

Payment is processed through "SHOPER PAYMENTS," operated by Blue Media S.A.

Buyers can place an Order using one of three options:
-
Option 1 If the Buyer does not have an Account, one may be created during the Order process by selecting "Register." The Buyer must provide the following data: email, first name, last name, phone number, password, delivery address, and submit the Order.

Option 2 Buyers can complete their purchase without registration by selecting "Place Order" without registering, then providing: email, first name, last name, phone number, and delivery address.

Option 3 If the Buyer already has an Account, select "Log in" to place an Order and complete the purchase using the Account.

The Shop confirms receipt of the Order and the conclusion of the Agreement via an automatically generated email sent to the Buyer. The confirmation email includes: Order number, estimated delivery date, delivery cost, total Order value, Buyer details, delivery details, and a list of ordered Products.

The total Order value, including the Product price and delivery cost, is displayed in the cart after the Buyer selects the payment and delivery method. The Product’s weight and final price are shown on the VAT invoice or receipt.

If the terms of the Sales Agreement differ from the Order placed by the Buyer, they must notify the Shop within 24 hours by email at sklep@steki.pl, specifying all discrepancies. If valid, these will be promptly corrected, and the Shop will contact the Buyer via email or phone.

An Agreement with a Consumer is concluded when the Buyer selects "Order and Pay."

An Agreement with a Business Entity is concluded upon the Seller's acceptance of the Order, which the Seller will confirm within 48 hours of the Order being placed.

Orders placed by Entrepreneurs and paid through the electronic payment system will be processed no later than 3 days after the payment is credited to the Seller's account, subject to point 8 above.

The Shop confirms the dispatch of the purchased Products. Invoices are sent electronically to the email address provided by the Buyer upon payment for the Order.
§ 7
[Price: Rules for Determining Prices]

Prices displayed in the Shop are in Polish złoty (PLN) and include VAT.
-
The final (total) amount payable by the Buyer includes the Product price and delivery cost, which the Buyer is informed about during the Order process, including at the time of expressing their intention to enter into the Sales Agreement.

Product Weight: The Seller offers Products with a fixed weight, which may vary by +/- 10% from the weight specified on the Shop's website.

The Shop reserves the right to change prices and withdraw specific Products presented on the Shop's website. Price changes or Product withdrawals do not affect Orders already accepted for fulfilment.

The Shop does not use any algorithms that adjust Product prices for individual consumers or consumer groups based on automated decision-making.
§ 8
[Delivery and Payment]

The Seller offers delivery of Products via in-house transport or courier services. After entering a postal code and filling the cart, Buyers are presented with the appropriate delivery method and cost for their location.

Products are delivered to the address provided during the Order process. Buyers may also choose the option of personal collection of ordered Products, which can be collected at the Shop's address provided in §2.

Order fulfilment time: Order fulfilment time starts upon successful payment authorisation. Details on processing times are provided athttps://steki.pl/czasrealizacjizamowien

If payment is made via bank transfer or card, the fulfilment time starts from the day the Seller’s bank account or settlement account is credited.

The order fulfilment time is calculated from the moment of successful payment authorisation.

Delivery time depends on the day the Order is placed, the delivery location, and the chosen delivery method.

Orders are not processed on Sundays, public holidays, or non-working days.

Buyers make payments through Shoper Payments, operated by Blue Media S.A. and PayPro S.A. (Przelewy24).

Available payment methods: Visa, Visa Electron, MasterCard, MasterCard Electronic.

If a refund is necessary for a transaction made with a payment card, the Seller will return the funds to the bank account linked to the card used for the transaction.

Buyers must complete payment within 3 calendar days from the conclusion of the Sales Agreement. Failure to complete the payment within the specified period will result in the Order being cancelled.

If a delivery method other than personal collection is selected, the Product will be delivered within the timeframe specified in its description, starting from the date of payment completion.
-
For personal collection, Products will be ready for pick-up at the specified time in the Product description. Buyers will be notified via email when their order is ready for collection.
§ 9
[Right to Withdraw from the Sales Agreement]

Under the provisions of the Consumer Rights Act of 30 May 2014, Buyers who are Consumers, as defined by the Civil Code, have the right to withdraw from the contract within 14 days of receiving the ordered goods without providing a reason. The withdrawal must be submitted in writing.

This right applies only to consumer sales contracts concluded between the Shop and a Consumer or individuals entering into contracts directly related to their business activity, provided the contract does not have a professional nature.

The withdrawing Consumer must return the goods immediately, but no later than 14 days from the date of withdrawal. Returned goods must remain unchanged unless the change was necessary to assess their nature, features, or functionality. The Consumer is liable for any reduction in the value of the goods resulting from use beyond what is necessary.

Returns are not accepted for goods exempted from withdrawal under applicable law, particularly:

Goods in sealed packaging that cannot be returned for health or hygiene reasons once opened.

Non-prefabricated goods made to the Consumer’s specifications or to meet their individual needs.
-
Goods that are perishable or have a short shelf life.
-
Consumers bear the direct costs of returning goods.
§ 10
[Rules for Processing Buyers’ Personal Data]

The rules for processing personal data and the use of cookies are described in the Privacy Policy available on the Shop’s website.
-
Buyers are required read the Seller’s personal data processing policy before placing an Order, particularly their rights as a data subject. A declaration of reding and understanding these policies is mandatory for placing an Order in the Shop.
§ 11
[Complaints and Returns]

The Shop is liable to the Buyer for nonconformity of the Product or service with the contract, as specified in:

The Act of 30 May 2014 on Consumer Rights – for Buyers who are consumers or individuals entering into contracts directly related to their business activity, provided the contract does not have a professional nature based on their registered business activities.

The Civil Code – for all other Buyers.
-
In the event of nonconformity of a food Product with the contract, Buyers have the right to request a replacement, a price reduction, or to withdraw from the contract, provided they notify the Seller immediately upon discovering the nonconformity, but no later than 3 days after the Order's delivery, subject to point 3 below. To file a complaint, the Buyer should contact the Seller via email or phone.

The determination of nonconformity must be made no later than the Product’s expiration date.

Complaints will be processed within 7 days, and the Buyer will be informed of the outcome in writing via email or postal address. If the Seller does not respond within the specified period, the complaint will be deemed accepted.

The Shop will refund the Buyer for returned/nonconforming Products within 7 days of a positive resolution, to the account specified by the Buyer via email.
-
The Seller does not accept cash-on-delivery parcels.
-
Product photos displayed in the Shop serve as illustrations of specific types of Products.
-
Products returned under the complaint procedure must be sent under controlled conditions at a temperature of 1-3°C to the address specified in Section 2 of these Terms and Conditions.
§ 12
[Out-of-Court Complaint and Dispute Resolution Procedures]

Detailed information about the possibility of using out-of-court complaint and dispute resolution methods by Consumers, as well as access to these procedures, is available at the offices and websites of municipal (city) consumer ombudsmen, social organisations involved in consumer protection, Provincial Inspectorates of the Trade Inspection, and at the following websites of the Office of Competition and Consumer Protection:

Consumers have the following options for out-of-court complaint and dispute resolution:

They can request the permanent consumer arbitration court, as referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), to resolve disputes arising from a contract concluded with the Seller.

They can request the Provincial Inspector of the Trade Inspection, under Article 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), to initiate mediation proceedings for amicable dispute resolution between the Consumer and the Seller.
-
Consumers can also obtain free assistance in resolving disputes with the Seller by contacting municipal (city) consumer ombudsmen or social organisations dedicated to consumer protection (e.g., the Consumer Federation, Polish Consumers’ Association).

For Entrepreneurs, disputes arising under these Terms and Conditions or sales contracts will first be resolved amicably through negotiations or mediation. If no contract is reached, disputes will be resolved by the common court competent for the Seller's registered office..

Pursuant to Article 14 of Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on Online Dispute Resolution for consumer disputes, the Shop provides a link to the EU ODR platform, available at: http://ec.europa.eu/consumers/odr/.

Agreements concluded through the Shop are in Polish.

The Seller reserves the right to amend these Terms and Conditions for valid reasons, including changes in law, payment and delivery methods, Shop functionalities, or business operations, to the extent that such changes affect the implementation of these Terms. Buyers will be informed of any changes at least 14 days in advance. Amendments will be published on the Shop's website at least 14 days before taking effect.

Matters not regulated by these Terms and Conditions are governed by the applicable laws of Poland, in particular: the Civil Code, the Act on Electronic Service Provision, the Consumer Rights Act, and the Data Protection Act.
